FUEL RATIONING IN ENSENADA!

ENSENADA MARINE DIESEL FUEL SUPPLIES AFFECTED
PEMEX is the world's fifth-largest oil company and Mexico's state oil monopoly, engaged in both upstream and downstream activities. The company accounts for approximately 30% of the Mexican government's revenues. Its vast oil and gas reserves include proven reserves of 34 billion barrels of oil equivalent. It is protected from competition in Mexico, where it enjoys a legal monopoly on the exploration, processing and sale of petroleum. And its privileged status in national mythology affords it a certain immunity from criticism. PEMEX is also in deep trouble. It's heavily-indebted and unable to provide the capital necessary to locate and exploit Mexico's oil deposits. In 2004, then Energy Minister Felipe Calderon announced that, without more investment, Mexico's known reserves could be depleted within 13 years. This wasn't the future envisioned by President Lazaro Cardenas, who expelled the foreign oil companies and founded PEMEX in 1938, to give Mexico's oil to "the people". Annual production has dropped each year since 2004. Furthermore, it has been reported the 2005-2006 daily oil production was down by approximately 500,000 barrels a day (a large proportion of the country's 4.5 million barrels) on the previous year.
The grades of PEMEX gasoline are "Magna" (Regular Unleaded 87 octane - green pump handle) and "Premium" (92 octane - red pump handle). Previously, PEMEX offered a leaded gasoline called "Nova," but this has been discontinued for environmental reasons (Nova gasoline, like many other leaded gasolines, have been discontinued due to stringent health regulations). Diesel fuel is readily available due to the large number of trucks on the highway - however, don't confuse the green Magna gasoline pump with a diesel pump as might be the case in the U.S.. The diesel pumps are often purple or red, and are usually sited on a separate island - the marking is "Diesel" or "Diesel Sin."
In our current newsletter an article describes the huge run on fuel here at the Coral Marina in Ensenada, Baja California, Mexico by luxury yachts and north of the border sportfishing craft. This has concerned Baja residents as there is a fear that this will force the price of fuel up locally, to the near $5 per gallon for diesel north of the border. Diesel fuel here is near $2 a gallon and many locals wondered how this glut of traffic trending south to fuel would affect the cost and supply of fuel here in Mexico.
Now we know the results of this recent run on fuel, the PEMEX oil company started rationing fuel to the Coral Marina PEMEX fuel dock on June 17th. The fuel dock had been pumping an entire PEMEX tanker truck per day, some 5000 gallons per day! As of now, the fuel supply will be rationed and quoting Fito Espinoza, the dock master here at the Coral Marina, “the fuel will be conserved for those in the marina’s use as top priority.” Already the activity at the fuel dock has lessened and the affects of this fuel rationing program are already being felt. This news will quickly filter through the yachting and commercial fishing community and soon the stream of yachts will abate visiting the Coral Marina only for fuel and not for the pleasure of enjoying the Coral Hotel and Marina’s many amenities.
Below: The luxury yacht Shana visited the Coral Marina PEMEX fuel dock for an all day process of taking on a huge quantity of diesel fuel. This entailed a wait for another tanker truck to deliver more fuel to complete the transaction. Yachts like this will now find it more difficult to find the fuel they desire at low local prices.

WILL THE 90 DAY YACHT CLUB DISAPPEAR OVER THE HORIZON AGAIN?
Governor’s proposed budget for 2008-09 would bring back one-year waiting period.

SACRAMENTO -- The rejoicing was almost unanimous in the boating community last summer, when California legislators brought back the sales tax exemption for boats purchased offshore and used out of the state for more than 90 days. However, because of the state’s impending budget shortfall, the governor has proposed a requirement for fiscal year 2008-09 that vessel, vehicle and aircraft purchases remain out of state for a full year to qualify for the exemption.
According to a report from Betty Yee, chairwoman of the state Board of Equalization, the move is expected to bring in “$21 million in additional General Fund revenues by making permanent the use tax on vessels, vehicles and aircraft brought into the state less than one year from purchase.”
The move brings back a measure enacted in 2004 to restrict the sales tax exemption. During last year’s budget negotiations, California state Senate Minority Leader Dick Ackerman, R-Irvine -- a boat owner -- successfully convinced fellow legislators to remove a renewal of the one-year out-of-state requirement from the 2007-08 budget.
At the time, Sen. Ackerman said the 2004 law restricting the sales tax exemption “was going to be an experiment,” and he believes that experiment had failed. Yacht brokers and boat builders statewide had been adversely affected by 2004’s tougher requirements for buyers who sought to avoid sales tax, Ackerman said.
A return to the 90-day out-of-state requirement for offshore deliveries provided a valuable incentive for new buyers, and was expected to result in increased sales of larger vessels by California yacht dealers and brokers.
The return of the 90-day requirement was approved as one of several budget compromises with Democratic legislators, which resulted in passage of the $145.5 billion budget signed by Gov. Arnold Schwarzenegger last Aug. 25.
Sen. Ackerman recently told members of the California Yacht Brokers Association that this time around, he will need extensive data on the effect of the 90-day exemption on yacht sales -- and the related impact on vessel repair, accessory sales, marine service and tourism industries -- to convince legislators of the value of keeping the “old rules.”
Meanwhile, boaters can make their voices heard on this issue by contacting their California Assembly representatives at www.assembly.ca.gov , California state senators at www.sen.ca.gov and Gov. Arnold Schwarzenegger at www.gov.ca.gov .

SACRAMENTO -- State university
students, mass transit riders and the low-income elderly will all feel some pain
from the budget the Legislature passed Tuesday. But for one select group, the
spending plan could prove a financial boon: owners of yachts, planes or
recreational vehicles.
They will once again be able to avoid paying sales tax if they keep those items
out of the state for just 90 days after purchase. That's how the law worked
before 2004, when lawmakers closed what most considered a loophole by requiring
state residents to keep those pricey purchases out of the state for a year to
receive a sales tax exemption.
The stiffer rules forced more yacht, plane
and RV owners to pay their fair share, according to the nonpartisan Legislative
Analyst's Office. The result: a $45-million boost in revenue for the state each
year since 2004.
A book for yacht owners, "The 90 Day Yacht Club Guide to
Ensenada," schools Californians on the art of avoiding sales tax by temporarily
docking in Mexico.
A provision intended to keep the one-year requirement in place was removed from
the budget last month at the insistence of Senate Republican Leader Dick
Ackerman of Irvine, himself a yacht owner.
"It's a commitment we made to Dick Ackerman," said Assembly Speaker Fabian Nuñez
(D-Los Angeles), who in 2004 fought to stiffen the tax exemption's eligibility
rules during budget negotiations. "Hopefully they will make him president of the
yacht club or something."
Ackerman said in an interview Tuesday that the stiffer rules were pushing yacht
brokers and manufacturers out of the state. The boost in sales tax payments was
the result of more Californians buying jet skis and smaller vessels, not yacht
owners forgoing that long trip to Mexico, he said.
Gov. Arnold Schwarzenegger has worked with Democrats to keep the one-year
requirement in place. It had been renewed each year since it was enacted --
until now.
"This was going to be an experiment," Ackerman said of the 2004 law -- one he
believes has failed. Others say the sales tax break is an outright giveaway.
"Everybody recognized this as a scam," said Lenny Goldberg, executive director
of the nonprofit California Tax Reform Assn. "People had even made a business
out of this scam. And now the state is going to permit it again."

ENSENADA, THE SECOND MOST VISITED CRUISE SHIP PORT IN MEXICO
Three new shipping lines recently decided to make Ensenada a stop on their itinerary. Currently Ensenada is second only to Cozumel on the Atlantic coast in the number of passenger delivered for an introduction to Mexican culture, carefree shopping, and revelry seeking. Over 500,000 visitors arrived in the year 2004, a historical record. The Princess, Holland America, and Celebrity lines have joined the Carnival and Caribbean cruisers that previously found Ensenada an attractive destination. 25 new-planed arrivals have been added to the passenger shipping schedule. This pushed the 2005 passenger count to over 1 million True Travelers dancing on the tables till the ship shoves off and whisks them out to sea at sunset for a slow cruise designed to give the passengers plenty of time to eat, drink, and gamble.
